After an accident, the insurance company sends its assessor. They decide what the repair is worth, whether the car is a write-off and, sometimes, how the collision happened. But that assessor works for the company. If their figure or their version does not add up, you are entitled to defend yourself with your own report.

When it is worth it
- Disputed write-off: you are offered the market value, an amount that is not enough to buy an equivalent car.
- Repair valued too low: hidden damage not taken into account, parts not replaced or an estimate that does not cover what the garage asks for.
- No agreement on fault: each driver gives a different version and the insurer refuses to pay or proposes splitting the blame.
- Injuries: the compensation offer does not properly reflect the days off work, the after-effects or the expenses.
- Accidents involving motorbikes, bicycles or scooters, where personal injuries tend to be greater and the reconstruction of the accident more disputed.
What the expert analyses
- The damage to the vehicle: what really needs repairing, with which parts and at what cost.
- The value of the vehicle before the accident, to know whether it is a write-off and how much should be paid.
- How the accident happened: speeds, trajectories, points of impact and visibility, based on the police report, photos, damage and, if available, videos.
What to do from the very start
- Photograph the vehicles, their position on the road and the signs, and keep any video (dashcam, a shop’s camera or a witness’s phone).
- Request the police report if the Local Police or Guardia Civil attended.
- Do not repair or sell the car before your expert has seen it if you are going to dispute the valuation.
- Do not wait: the general time limit to claim damages for a traffic accident is one year.
Why an expert report
Against the insurer’s report, only another technical report carries the same weight. Your own expert report lets you negotiate with the company using facts and, if there is no agreement, take the claim to court. If there is a lawsuit, we defend the report before the judge at the ratification hearing.
